1. About Arcly
Arcly is a property numbers toolkit operated by Arcly Pty Ltd (ABN 29 697 622 165), a company registered in Western Australia, Australia.
The platform provides property deal calculators, cashflow analysis, flip modelling, transfer cost estimates, first home buyer scheme information, deal pipeline management, and PDF report generation for users in Australia.
Arcly is not a financial adviser, mortgage broker, real estate agent, accountant, tax adviser, or legal practitioner under any Australian legislation. Use of Arcly does not create any advisory, fiduciary, or professional relationship between the user and Arcly Pty Ltd.
2. Acceptance of Terms
By creating an account and ticking the acceptance checkbox at sign-up, the user agrees to be bound by these Terms & Conditions in full. If the user does not agree, they must not create an account or use the platform.
These terms constitute a binding legal agreement between the user and Arcly Pty Ltd. Arcly reserves the right to update these terms at any time with notice provided via email or in-app notification. Continued use after notice of updated terms constitutes acceptance of the revised terms.
Users must be 18 years or older to create an account.
3. Not Financial Advice (Critical)
All calculations, outputs, verdicts, scores, projections, estimates, and reports generated by Arcly are for informational and illustrative purposes only.
Nothing on Arcly constitutes financial advice, investment advice, tax advice, legal advice, mortgage advice, or any other form of professional advice under the Corporations Act 2001 (Cth) (AU), the National Consumer Credit Protection Act 2009 (AU), or any other applicable legislation.
Arcly is not licensed by the Australian Securities and Investments Commission (ASIC) to provide financial advice.
The go/no-go verdict, deal score, profit estimates, yield calculations, cashflow projections, equity projections, sensitivity tables, stamp duty calculations, LMI estimates, LVR warnings, negative gearing estimates, tax saving estimates, and first home buyer scheme information are estimates only and may not reflect actual outcomes.
Stamp duty calculations are based on published bracket tables and may not account for individual circumstances, concessions, exemptions, or legislative changes. First home buyer scheme information is indicative only — eligibility is determined by the relevant government authority, not Arcly. LMI and LVR figures are estimates only — actual lending decisions are made by banks and lenders, not Arcly. Tax and negative gearing estimates do not constitute tax advice; users must consult a registered tax agent or accountant.
The user acknowledges that property investment involves significant financial risk, including the risk of loss of capital. The user agrees that Arcly Pty Ltd bears no responsibility for any investment decision made in whole or in part based on outputs from the platform. The user agrees to seek independent financial, legal, and tax advice from qualified professionals before making any property investment decision.
4. Australia-Specific Terms
Arcly's Australian features operate under Australian Consumer Law (ACL) as contained in the Competition and Consumer Act 2010 (Cth).
Stamp duty calculations are based on published state and territory revenue office rates for NSW, VIC, QLD, WA, SA, TAS, ACT, and NT — rates are updated periodically but may not reflect recent legislative changes. First Home Owner Grant (FHOG) information is sourced from state revenue office publications and is indicative only. First Home Super Saver (FHSS) scheme information is indicative only — eligibility and amounts are determined by the Australian Taxation Office.
Negative gearing and tax estimates are based on general principles and do not constitute advice from a registered tax agent under the Tax Agent Services Act 2009. LMI estimates are based on publicly available lender mortgage insurance thresholds and may differ from amounts charged by actual lenders. Nothing in Arcly's outputs should be construed as credit advice under the National Consumer Credit Protection Act 2009.
To the extent permitted by Australian Consumer Law, Arcly limits its liability to the resupply of services or the cost of having services supplied again.
6. Accuracy of Calculations
Arcly makes reasonable efforts to ensure calculations are accurate but does not warrant that outputs are free from error. Property markets, interest rates, tax legislation, lending rules, and government schemes change frequently — Arcly does not guarantee that all data reflects the current legislative or market position.
Users are responsible for verifying all figures with qualified professionals before acting on them. Arcly accepts no liability for losses arising from errors, omissions, or outdated information in any calculation or output.
7. AI Features
Arcly includes AI-powered features, including but not limited to the AI photo analyser. AI outputs are generated by third-party artificial intelligence models and are estimates only.
AI-generated renovation cost estimates, property assessments, and any other AI outputs are not professional assessments and must not be relied upon as such. Arcly does not warrant the accuracy of any AI-generated output.
Users must not upload images of people, private individuals, or any content they do not have the right to upload. Arcly reserves the right to limit or suspend AI feature access to manage costs and prevent abuse.
8. Subscription, Billing & Trial
Arcly offers a 14-day free trial of the Operator Deck plan — no credit card is required to start the trial. During the trial the user has access to the full Operator Deck feature set for evaluation, with the exception of PDF, XLSX and CSV exports and live shareable links, which are reserved for paid plans. After the trial period ends, the user's account is restricted to read-only access until a paid plan (Solo Command or Operator Deck) is selected. Saved deals and account data are preserved while the user decides.
Subscription fees are charged monthly or annually as selected at sign-up. All prices are displayed in Australian Dollars (AUD). Subscriptions renew automatically unless cancelled before the renewal date.
Cancellation takes effect at the end of the current billing period — no partial refunds are provided for unused time within a billing period. Arcly reserves the right to change subscription pricing. We will give you at least 30 days notice of any price increase via email before it takes effect. Continuing to use the service after the effective date constitutes acceptance of the new price. Refunds are provided at Arcly's discretion in accordance with Australian Consumer Law obligations.
9. User Accounts & Security
Users are responsible for maintaining the confidentiality of their account credentials. Users must not share account access with third parties.
Arcly reserves the right to suspend or terminate accounts that breach these terms. Users must notify Arcly immediately of any unauthorised access to their account.
Arcly uses Clerk for authentication — by creating an account, users also agree to Clerk's terms of service.
10. Intellectual Property
All content, calculations, algorithms, designs, code, and reports generated by Arcly are the intellectual property of Arcly Pty Ltd.
Users may not copy, reproduce, resell, or distribute Arcly's outputs for commercial purposes without written permission. White-label PDF exports available to Operator Deck subscribers may be used for the user's own client presentations — they may not be resold as a standalone product.
User-submitted data remains the property of the user — Arcly does not claim ownership of data entered into the platform.
11. Privacy & Data
Arcly collects and processes personal data in accordance with the Privacy Act 1988 (AU). A separate Privacy Policy governs how data is collected, stored, and used — users agree to the Privacy Policy by accepting these terms.
Arcly does not sell user data to third parties. User financial data entered into calculators is stored securely and used only to provide the service. Arcly uses third-party services including Clerk (authentication), Vercel (hosting), and others — these providers have their own privacy policies.
12. Limitation of Liability
To the maximum extent permitted by law, Arcly Pty Ltd, its directors, employees, and contractors are not liable for any direct, indirect, incidental, consequential, or special damages arising from use of the platform.
Arcly's total liability to any user in any 12-month period is limited to the total subscription fees paid by that user in that period.
Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law including under Australian Consumer Law.
13. Governing Law
These Terms are governed by the laws of Western Australia, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Western Australia.
